Special Town Council Meeting Minutes 9/1/09

The following minutes were taken from the special meeting of the Mayor and Board of Aldermen on September 1, 2009 in the Town Hall of Abita Springs.

Alderman Edmiston gave the Invocation and Alderman Lemons led the Pledge of Allegiance.

Mayor Fitzmorris called the roll and present were Alderman Campbell, Dugas, Edmiston, and Lemons. Absent was Alderman Patterson.

Mayor Fitzmorris called the meeting to order and opened the Public Hearing on the Town Home/Condo Amendment Ordinance. He described the property as being the Abita Oaks property located on Hwy 36 across from the Fire Department. Mayor Fitzmorris explained Planning and Zoning has made a recommendation to amend the Town Home/Condo Ordinance to allow for detached single family dwellings. He noted the changes were to have 10 feet between property lines and 2 parking spaces per dwelling. Mayor Fitzmorris ask the Council and Public if there were any questions. Mr. Bush questioned the selling amount of the homes. Mr. Bernard stated the homes will be sold for around $250,000.00. Mayor Fitzmorris advised the bank is starting to clean up the lots, turn the lights on and will address drainage issues before any building begins. Mayor Fitzmorris mentioned he and Planning and Zoning Director, Cindy Chatelain went to Tangipahoa Parish to look at the cottages that were built there and agreed they are very nice. Mayor Fitzmorris noted no vote will be taken tonight until a few more details are worked out and there is a definite plan for property to be purchased. Mayor Fitzmorris ask that this be deferred until the September Town Council Meeting. A concerned resident questioned the safety of the children regarding traffic, fires, etc. Alderman Lemons reported the water system has 750 gallons per minute and the fire truck was able to go through roads. Mayor Fitzmorris answered an inquiry that the homes will be built around the circle. Discussion followed on zoning and zoning changes. Mayor Fitzmorris noted the home will follow historic guidelines. They will be built on a slab but have a raised look appearance. Discussion followed on parking, lot sizes, and traffic. A concerned resident ask if the town would consider putting speed bumps on St. Charles street, Mayor Fitzmorris said he would consider putting them on 9th Street to help slow the traffic down. There were some questions regarding drainage, Town Engineer, Jean Thibodeaux advised they are going back to address this problem first before any building will start. More discussion and verification followed on zoning changes. Alderman Edmiston made a motion to close the Public Hearing, seconded by Alderman Lemons, Vote was: YEAS: 3, Alderman Campbell, Edmiston and Lemons, NAYS: 0, ABSENT: 1, Alderman Patterson, ABSTAIN: 1, Alderman Dugas. Alderman Campbell made a motion to defer the Town Home/Condo Ordinance Amendment to the September 15, 2009 Town Council Meeting, seconded by Alderman Lemons. Vote was: YEAS: 3, Alderman Campbell, Edmiston, Lemons, NAYS: 0, ABSENT: 1, Alderman Patterson, ABSTAIN: 1, Alderman Dugas.

Mayor Fitzmorris introduced Administrative Assistant, Donna Kilpatrick who summarized the CDGB Resolutions.
Resolution # 1 Citizen Participation Plan Resolution. Alderman Campbell made a motion to adopt the Citizen Participation Plan Resolution, seconded by Alderman Dugas. Vote was: 4, Alderman Campbell, Dugas, Edmiston and Lemons, NAYS: 0, ABSENT: 1, Alderman Patterson, ABSTAIN: 0.
Resolution #2 Citizen Complaint Procedure Resolution. Alderman Campbell made a motion to adopt the Complaint Procedure Resolution, seconded by Alderman Dugas. Vote was: 4, Alderman Campbell, Dugas, Edmiston and Lemons, NAYS: 0, ABSENT: 1, Alderman Patterson, ABSTAIN: 0.
Resolution #3 Procurement Policy of the Town of Abita Springs. Alderman Campbell made a motion to adopt the Procurement Procedures of the Town of Abita Springs Resolution, seconded by Alderman Dugas. Vote was: 4, Alderman Campbell, Dugas, Edmiston and Lemons, NAYS: 0, ABSENT: 1, Alderman Patterson, ABSTAIN: 0.
Resolution #4 Residential Anti-Displacement and Relocation Assistance Plan. Alderman Campbell made a motion to adopt the Residential Anti-Displacement and Relocation Assistance Plan Resolution, seconded by Alderman Dugas. Vote was: 4, Alderman Campbell, Dugas, Edmiston and Lemons, NAYS: 0, ABSENT: 1, Alderman Patterson, ABSTAIN: 0.
Resolution #5 Section 504 Grievance Procedure and Coordinator Appointment. Alderman Campbell made a motion to adopt the Section 504 of the Rehabilitation Act of 1973 Resolution as amended, seconded by Alderman Dugas. Vote was: 4, Alderman Campbell, Dugas, Edmiston and Lemons, NAYS: 0, ABSENT: 1, Alderman Patterson, ABSTAIN: 0.
Resolution #6 Policy Statement for Communicating Information to Persons with Sensory Impairments. Alderman Campbell made a motion to adopt the Policy Statement for communicating Information to Persons with Sensory Impairments Resolution, seconded by Alderman Dugas. Vote was: 4, Alderman Campbell, Dugas, Edmiston and Lemons, NAYS: 0, ABSENT: 1, Alderman Patterson, ABSTAIN: 0.
Resolution #7 Fair Housing Coordinator Appointment Alderman Campbell made a motion to adopt the Fair Housing in Compliance with Title VIII of the Civil Rights Act of 1968 Resolution as amended and Executive Order 11063 Resolution as amended, seconded by Alderman Dugas. Vote was: 4, Alderman Campbell, Dugas, Edmiston and Lemons, NAYS: 0, ABSENT: 1, Alderman Patterson, ABSTAIN: 0.
Resolution #8 Equal Opportunity Officer Appointment. Alderman Campbell made a motion to adopt the Equal Opportunity Office Resolution, seconded by Alderman Dugas. Vote was: 4, Alderman Campbell, Dugas, Edmiston and Lemons, NAYS: 0, ABSENT: 1, Alderman Patterson, ABSTAIN: 0.
